1. Introduction and Acceptance

These Terms and Conditions (“Agreement”) are a legally binding contract between you (“User”, “you”) and PANDANIO.COM (“the Site”, “we”). Your use of our services signifies your full and unconditional agreement to these terms, including the Privacy Policy which is an integral part thereof.

2. Eligibility and Verification

Any person under the age of 18 (“minor”) is strictly prohibited from using this site. Your use of the service is a final declaration and commitment that you are of legal age. We reserve the right to request proof of identity or age at any time and for any reason we deem necessary to enforce this policy. Failure to comply with this request will result in the immediate suspension or permanent termination of the account.

3. Account Security

You are solely responsible for the confidentiality of your account information. We provide and strongly recommend enabling Two-Factor Authentication (2FA) as an additional layer of protection. The user acknowledges that not enabling this feature increases the risk of unauthorized access and assumes the resulting liability. We are committed to implementing security measures to protect our systems, but we will only be liable for direct damages resulting from proven gross negligence on our part. You must notify us of any breach within 48 hours of becoming aware of it.

4. Fraud Prevention and Verification

We reserve the right to request Know Your Customer (KYC) verification for any transaction. We use advanced anti-fraud systems and may decline any transaction we deem suspicious. In case of suspected fraud, we reserve the right to suspend the account for the time necessary to conduct an internal investigation, and we may add the user’s data to our internal blacklist to prevent future dealings.

5. Sales and Delivery Policy

All sales are final and non-refundable once delivery is complete, without prejudice to any non-excludable rights you may have under applicable consumer protection laws. Digital products are delivered exclusively within your account’s dashboard on the site. Returns or exchanges are only permitted in the case of a substantial technical defect, provided it is reported within 72 hours of delivery.

6. Limited Warranty

We guarantee the validity of the digital products sold for a period of 7 days from the date of delivery. Compensation is limited to the replacement of the product, or a full refund if replacement is not possible.

7. Acceptable Use and Intellectual Property

The use of our services for any illegal activity is prohibited. All content on the site is our exclusive property and is legally protected.

8. Termination of Service

We reserve the right to suspend or terminate your account immediately and without prior notice if you violate any of the terms of this Agreement.

9. Limitation of Liability (Key Protection Clause)

To the maximum extent permitted by law, we will not be liable for any indirect or incidental damages. In all cases, our total liability to you for any claim shall not exceed the total amount you paid to us during the three (3) months preceding the event. We will also not be liable for any failure or delay in performance if it is caused by events beyond our reasonable control (force majeure).

10. Indemnification (Key Protection Clause)

The user agrees to indemnify, defend, and hold harmless PANDANIO.COM from any claims, losses, or expenses (including attorneys’ fees) arising from your violation of these terms or your illegal use of the service.

11. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the United Arab Emirates. In the event of any dispute, the parties agree to attempt to resolve it amicably through good faith negotiations for a period of thirty (30) days. If negotiations fail to resolve the dispute within this period, the dispute shall be referred exclusively to the competent courts in the Emirate of Dubai.

12. Amendments

We may amend these terms. We will notify you of material amendments via email 15 days before they take effect.
